DINK4RENT TERMS OF USE

Welcome to Dink4Rent.com (“Dink4Rent,” “we,” “our,” or “us”).

These Terms of Use (“Terms”) govern your access to and use of Dink4Rent.com, our websites, mobile applications, and related services (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. DESCRIPTION OF SERVICE

Dink4Rent is an online marketplace and information platform that allows users to discover, book, rent, review, and obtain information regarding pickleball equipment rentals, court reservations, coaching services, and related pickleball gear and accessories.

Dink4Rent does not own, operate, manage, endorse, or control most businesses, courts, or services listed on the Platform unless expressly identified as such.

2. ELIGIBILITY

You must be at least 18 years old or the age of majority in your jurisdiction to create an account, submit content, or make a booking on the Platform.

By using the Platform, you represent and warrant that:

• You have the legal capacity to enter into these Terms.
• All information you provide is accurate and current.
• Your use of the Platform complies with applicable laws.

3. USER ACCOUNTS

Certain features may require account registration.

You agree to:

• Maintain accurate account information.
• Keep your login credentials confidential.
• Accept responsibility for all activities occurring under your account.
• Notify us immediately of any unauthorized access.

We reserve the right to suspend or terminate accounts at our sole discretion.

4. LISTINGS

Businesses, court owners, coaches, and equipment providers may submit, claim, update, or manage listings on the Platform.

By submitting a listing, you represent and warrant that:

• You own or have authority to provide the submitted information.
• The information is accurate and not misleading.
• The listing does not violate any law or third-party rights.
• You have the right to rent or sublease the equipment or court space listed.
• Any coaching services offered are provided by qualified individuals.

We reserve the right to:

• Edit listings for formatting, clarity, or consistency.
• Remove inaccurate or prohibited listings.
• Reject listings at our sole discretion.

Listing on Dink4Rent does not constitute endorsement by Dink4Rent.

5. USER-GENERATED CONTENT

Users may submit reviews, ratings, comments, photos, videos, descriptions, and other content (“User Content”).

You retain ownership of your User Content.

By submitting User Content, you grant Dink4Rent a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable license to use, host, store, reproduce, publish, display, modify, adapt, and distribute such content in connection with operating, marketing, improving, and promoting the Platform.

You may request removal of your User Content through your account settings or by contacting us, subject to applicable law.

6. CONTENT RULES

You may not post content that:

• Is false, misleading, or deceptive.
• Is defamatory or harassing.
• Violates intellectual property rights.
• Contains hate speech or threats.
• Promotes illegal activities.
• Contains malware or malicious code.
• Includes private or confidential information without authorization.
• Impersonates another person or business.

We may remove content at any time without notice.

7. REVIEWS AND RATINGS

Reviews reflect the opinions of individual users and not Dink4Rent.

We do not verify the accuracy of reviews and make no guarantees regarding:

• Authenticity
• Reliability
• Accuracy
• Completeness

We reserve the right to remove reviews that violate these Terms.

Businesses may not manipulate, purchase, incentivize, or otherwise artificially influence reviews.

Business owners may submit a review dispute request if they believe a review violates these Terms. Dink4Rent will review the request and may remove or decline to remove the review at its sole discretion.

8. INTELLECTUAL PROPERTY

The Platform and all related software, content, trademarks, logos, graphics, designs, databases, and proprietary materials are owned by Dink4Rent or its licensors and are protected by intellectual property laws.

Except as expressly permitted, you may not copy, reproduce, scrape, distribute, sell, reverse engineer, or create derivative works without prior written consent.

9. PROHIBITED ACTIVITIES

You agree not to:

• Scrape, harvest, crawl, data mine, or use automated systems to extract Platform content.
• Use bots or automated systems to access the Platform.
• Circumvent security measures.
• Interfere with Platform operations.
• Attempt unauthorized access.
• Collect personal information from users.
• Use the Platform for spam or fraudulent purposes.

We may block or terminate access for violations.

10. THIRD-PARTY CONTENT AND LINKS

The Platform may contain links to third-party websites and services, including equipment manufacturers, court booking systems, and coaching platforms.

We do not control or endorse third-party content and are not responsible for:

• Accuracy
• Availability
• Security
• Practices
• Policies

Your interactions with third parties are solely between you and the third party.

11. ADVERTISING AND SPONSORED CONTENT

The Platform may display advertisements, sponsored listings, affiliate links, or promotional content.

Sponsored placements may receive preferential visibility.

Dink4Rent may receive compensation from advertisers or affiliate partners. We may earn commissions from purchases made through affiliate links on the Platform, including pickleball equipment, apparel, and accessories from partner brands.

12. BOOKING AND RENTAL SERVICES

The Platform may facilitate bookings, reservations, and rentals of pickleball equipment, courts, and coaching services (“Booking Services”).

By using Booking Services, you agree to:

• Reservations: Bookings are subject to availability and confirmation by the listing owner. Dink4Rent facilitates the connection but does not guarantee fulfillment.
• Payment: Payments are processed by third-party payment providers. Their terms and conditions apply to the transaction.
• Cancellation: Cancellation policies may vary by listing. The listing owner’s cancellation policy, as displayed on the listing page, applies.
• Refunds: Refunds are handled according to the listing owner’s cancellation policy. Dink4Rent may facilitate dispute resolution but is not liable for refund outcomes.
• Equipment Damage: Renters are responsible for the care of rented equipment. Damage fees may apply per the listing owner’s terms. Dink4Rent is not liable for equipment damage or loss.
• No-Show: Listing owners may enforce no-show policies, including forfeiture of booking fees, as specified in their listing terms.
• Subscriptions: Premium features, including enhanced listings and priority placement, require paid subscriptions that automatically renew at the end of each billing period unless canceled before the renewal date.
• Price Changes: We may change pricing with 30 days’ advance notice. Continued use after a price change constitutes acceptance of the new price.

13. DISCLAIMER OF WARRANTIES

THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DINK4RENT DISCLAIMS ALL WARRANTIES, INCLUDING:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY
• RELIABILITY
• AVAILABILITY

WE DO NOT GUARANTEE THAT:

• LISTINGS ARE ACCURATE.
• EQUIPMENT WILL BE AVAILABLE OR IN EXPECTED CONDITION.
• COURTS WILL BE AS DESCRIBED.
• COACHING SERVICES WILL MEET EXPECTATIONS.
• REVIEWS ARE AUTHENTIC.
• THE PLATFORM WILL BE ERROR-FREE OR UNINTERRUPTED.

14. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DINK4RENT SHALL NOT BE LIABLE FOR ANY:

• INDIRECT DAMAGES
• INCIDENTAL DAMAGES
• SPECIAL DAMAGES
• CONSEQUENTIAL DAMAGES
• LOSS OF PROFITS
• LOSS OF DATA
• BUSINESS INTERRUPTION
• EQUIPMENT DAMAGE OR LOSS
• PERSONAL INJURY ARISING FROM USE OF RENTED EQUIPMENT OR FACILITIES

ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM.

OUR TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID TO US IN THE PRECEDING TWELVE MONTHS, WHICHEVER IS GREATER.

15. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Dink4Rent, its owners, officers, employees, contractors, affiliates, and agents from any claims, damages, liabilities, losses, costs, and expenses arising from:

• Your use of the Platform.
• Your submitted content.
• Your violation of these Terms.
• Your violation of applicable laws or third-party rights.
• Your use of rented equipment, booked courts, or coaching services.
• Any injury or damage arising from your participation in pickleball activities.

16. DMCA AND COPYRIGHT COMPLAINTS

If you believe content infringes your copyright, submit a written notice including:

• Identification of the copyrighted work.
• Identification of the allegedly infringing material.
• Your contact information.
• A statement of good-faith belief that the use is not authorized.
• A statement made under penalty of perjury regarding your claim and that you are authorized to act on behalf of the copyright owner.
• Your physical or electronic signature.

We may remove allegedly infringing material upon receiving a valid notice.

Counter-Notice: If you believe your content was removed in error, you may submit a written counter-notice including:

• Identification of the removed material and its location before removal.
• A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
• Your name, address, telephone number, and a statement consenting to the jurisdiction of the federal courts in Orange County, California.
• Your physical or electronic signature.

Upon receiving a valid counter-notice, we may restore the removed content in accordance with applicable law.

17. PRIVACY

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

18. TERMINATION

We may suspend, restrict, or terminate your access at any time without notice for any reason, including violation of these Terms.

Upon termination, your User Content may remain publicly visible unless you request removal in accordance with Section 5.

Sections 5, 8, 9, 12, 13, 14, 15, 16, 18, 19, 20, 21, and 22 shall survive termination.

19. MODIFICATIONS

We may update these Terms at any time.

Updated Terms become effective upon posting.

Continued use of the Platform after changes constitutes acceptance of the revised Terms.

We will make reasonable efforts to notify users of material changes via email or Platform notification.

20. GOVERNING LAW

These Terms shall be governed by and construed under the laws of the State of California, without regard to conflict of law principles.

21. DISPUTE RESOLUTION

Any dispute arising from these Terms shall first be attempted to be resolved informally by contacting us.

If unresolved, disputes shall be submitted to binding arbitration in Orange County, California, except where prohibited by law.

Either party may proceed with a claim in small claims court if the amount is within that court’s jurisdiction.

You waive participation in class actions and class arbitrations to the fullest extent permitted by law.

22. SEVERABILITY

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

23. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any additional policies posted on the Platform, constitute the entire agreement between you and Dink4Rent regarding use of the Platform.
